Please read these Terms and Conditions carefully before signing up to KIN Library. By creating an account and/or purchasing a membership, you agree to be bound by these Terms. If you do not agree, please do not sign up.

KIN Library is operated by KIN Exercise Physiology, ABN 38502706591, trading as KIN Exercise Physiology (“KIN,” “we,” “us,” “our”), based in Brisbane, Queensland, Australia.


1. About KIN Library

KIN Library is an online platform providing video-based strength training content, including an exercise demonstration library and structured training programs, designed and reviewed by an Accredited Exercise Physiologist (AEP).

KIN Library membership is offered in two tiers:

  • KIN Essentials — access to the full exercise video library, technique guidance, and education content.
  • KIN Guided — includes everything in KIN Essentials, plus fully mapped multi-week structured programs.
  • KIN Premium – includes everything in KIN Guided, plus monthly mentor meetings/check-ins.

Current pricing, inclusions, and tier details are as displayed on the KIN Library website at the time of purchase and may change from time to time (see Section 5).

 


2. Health Disclaimer 

This platform is not a substitute for individualised clinical care.

  • KIN Library provides general exercise information and programming. It is not a substitute for individualised medical or allied health advice, diagnosis, or treatment.
  • Content is not tailored to your specific injury history, medical conditions, or circumstances unless you are working with KIN Premium under a separate individual consultation.
  • You should consult your doctor or another qualified health professional before beginning any new exercise program, particularly if you are pregnant, postpartum, recovering from injury or surgery, or managing a chronic health condition.
  • You must stop exercising immediately and seek medical attention if you experience pain, dizziness, shortness of breath, or any other concerning symptom during a session.
  • You are responsible for exercising within your own physical limits and using appropriate judgement, equipment, and technique. Where filters (e.g. “low back-friendly,” “postpartum”) are provided, these are general guides only and are not a clinical clearance.

 


3. Assumption of Risk and Liability

  • Participation in physical exercise carries inherent risk of injury. By using KIN Library, you voluntarily assume all risks associated with participation.
  • To the maximum extent permitted by law, KIN and its practitioners exclude liability for any injury, loss, or damage arising from your use of KIN Library content, except where such liability cannot be excluded under the Australian Consumer Law (Competition and Consumer Act 2010 (Cth)) or other applicable legislation.
  • Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded.

 


4. Membership, Billing and Renewal

  • Memberships are billed on a recurring monthly basis via Stripe from the date of signup, unless otherwise stated at checkout.
  • By subscribing, you authorise KIN to charge your nominated payment method automatically each billing cycle until you cancel.
  • It is your responsibility to keep your payment details current. If a payment fails, we may suspend your access until payment is resolved.
  • Membership tier changes (upgrades/downgrades) take effect immediately.

 


5. Changes to Pricing and Content

  • We may update membership pricing, tier inclusions, or platform content from time to time. Where practical, we will provide at least 30 days notice of a price increase to existing members via email.
  • Continued use of KIN Library after a price change takes effect constitutes acceptance of the new pricing.
  • We may add, remove, or update exercise videos and programs over time to keep content current and evidence-based.

 


6. Cancellation

  • You may cancel your membership at any time via your membership portal.
  • Cancellation takes effect at the end of your current billing period; you will retain access until that date, and no further charges will be made.
  • We do not provide refunds for partial billing periods, except where required by law (see Section 7).

 


7. Refunds

  • Fees are generally non-refundable once a billing period has commenced, except:
    • Where required under the Australian Consumer Law (e.g. if the service is not provided with due care and skill); or
    • At KIN’s discretion in exceptional circumstances.
  • To request a refund, contact us at mackenzie.fennell@outlook.com and we will respond within 3 business days.

 


8. Account Use

  • You must provide accurate information when creating your account and keep your login details confidential.
  • Membership is personal to you and may not be shared, transferred, or used by another person.
  • We reserve the right to suspend or terminate accounts that breach these Terms, misuse the platform, or share access in violation of this section.

 


9. Intellectual Property

  • All videos, programs, written content, branding, and materials within KIN Library are the intellectual property of KIN and are protected by copyright.
  • Your membership grants you a personal, non-transferable, non-exclusive licence to access and view content for your own personal use.
  • You may not download, reproduce, distribute, publicly share, or create derivative works from KIN Library content without our prior written consent.

 


10. Limitation of Liability

To the extent permitted by law, KIN’s total liability arising from or in connection with your use of KIN Library is limited to the amount you paid for your membership in the 3 months preceding the claim.


11. Privacy

When you sign up to KIN Library, we collect personal information such as your name, email address, and payment details (processed securely by our third-party payment provider) in order to create and manage your account, membership, and billing.

Our website and membership platform are built on WordPress, and video content is hosted and delivered via Vimeo — both of which may use cookies or collect technical data (such as IP address and device information) as part of normal operation.

Your data is used only to provide and improve KIN Library, communicate with you about your membership, and meet our legal obligations.


12. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified to members via email or in-platform notice. Continued use of KIN Library after changes take effect constitutes acceptance of the updated Terms.


13. Governing Law

These Terms are governed by the laws of Queensland, Australia, and you submit to the non-exclusive jurisdiction of the courts of Queensland.
